General Terms and Conditions for Lead Purchases
The terms governing the purchase of leads on the Objais Partners platform.
1. Scope
These General Terms and Conditions govern the purchase of exclusive or multiple leads made available through the Objais Partners platform (objais-partners.com), operated by Quotinsure Lda ("Quotinsure", "Objais Partners", "we"), a company with registered office at [address TBD], NIPC [TBD].
These General Terms apply exclusively to members with an active, approved account on the platform who purchase leads. They do not apply to co-brokerage between partners, which is governed by a separate co-brokerage agreement, signed separately prior to accessing co-brokerage lead data.
Acceptance of these General Terms is mandatory and occurs at the time of the first lead purchase on the platform, through express acceptance (checkbox).
2. Definitions
- Lead: contact information for a potential client interested in an insurance service or related service, made available through the platform.
- Exclusive Lead: lead made available to a single buyer.
- Multiple Lead: lead made available simultaneously to a limited number of buyers (indicated at the time of purchase).
- Buyer or Member: broker, intermediary or other professional with an approved account on the platform.
3. Eligibility
Only members with an approved account and a tier compatible with the type of lead sought, as indicated on the platform's Tiers page, may purchase leads.
4. Price and billing
The price of each lead is variable, determined based on the type of lead, insurance verticals, country and degree of exclusivity, and is presented to the buyer before confirmation of each purchase. We do not set a fixed price table here, as this is a dynamic value.
After the purchase, Quotinsure Lda issues the corresponding invoice, which will be sent to the email and/or billing details associated with the buyer's account.
5. Lead delivery
The lead's contact details are made available to the buyer immediately after payment confirmation, through the portal.
6. Lead quality and complaints
We make efforts to ensure that the leads made available correspond to real contacts genuinely interested at the time of collection. However, we do not guarantee the conversion of the lead into a client.
The buyer may lodge a complaint about a lead in the following situations, within 48 hours of purchase:
- Invalid or non-existent contact details (e.g. incorrect phone/email that make contact impossible)
- Duplicate lead, already previously acquired by the same buyer
- Lead that breaches the agreed exclusivity conditions
Substantiated and accepted complaints result in an equivalent credit for a future lead purchase, or a refund, at Quotinsure Lda's discretion.
7. Buyer obligations
The buyer undertakes to:
- Contact the lead within a reasonable timeframe (recommended: 48 hours) after acquisition
- Use the lead's data exclusively for commercial prospecting purposes related to the service in which the lead expressed interest
- Not resell, assign or transfer the lead to third parties
- Comply with all applicable personal data protection legislation (GDPR) when processing the lead's data, acting as an independent data controller with respect to that data
- Not use abusive, misleading or legally prohibited contact practices
8. Exclusivity
In the case of exclusive leads, Quotinsure Lda guarantees that the lead is not made available to any other buyer on the platform. In the case of multiple leads, the maximum number of buyers is indicated at the time of purchase.
9. Suspension and account termination
Quotinsure Lda reserves the right to suspend or terminate a member's access to lead purchases in case of breach of these General Terms, misuse of lead data, or fraudulent behaviour.
10. Limitation of liability
Quotinsure Lda does not guarantee commercial results arising from the acquisition of leads. Quotinsure Lda's liability towards the buyer is limited to the amount actually paid for the lead(s) in question.
11. Confidentiality
Lead data is confidential and may not be disclosed to third parties outside the scope of the business relationship with the end client.
12. Changes
Quotinsure Lda may update these General Terms periodically. Continued use of the platform after a change implies acceptance of the new terms.
13. Governing law and jurisdiction
These General Terms are governed by Portuguese law. Any dispute arising from these General Terms shall be subject to the exclusive jurisdiction of the courts of the district of Lisbon, with express waiver of any other jurisdiction.
